According to the prosecution, the events unfolded on the night of January 28, 2022, when Read and O’Keefe were out drinking with a group of current and former law enforcement officers at a bar in a Boston suburb.  Prosecutors allege that the couple got into an argument and that Read later dropped O’Keefe off at a party hosted by Brian Albert, a retired Boston police sergeant. 

In the early hours of January 29, 2022, Read claims she went out looking for O’Keefe when she realized he had not returned home from the party.  It was during this search that Read allegedly discovered O’Keefe’s body lying in a snowbank outside of Albert’s home.  One of the women with Read at the time, Jennifer McCabe, called 911. 

The Prosecution’s Case

The prosecution, led by Norfolk County Assistant District Attorney Adam Lally, has presented evidence suggesting that Read intentionally struck O’Keefe with her Lexus SUV, causing a skull fracture and brain bleed that ultimately led to his death.  Lally argues that Read then left O’Keefe in the snowbank to die, rather than seeking immediate medical attention. 

Prosecutors have pointed to several pieces of evidence to support their case, including:

  1. Forensic evidence: Investigators found a broken cocktail glass and pieces of a tail light at the scene, which they believe could have come from Read’s vehicle striking O’Keefe. 
  2. Toxicology reports: Forensic toxicologists estimated that Read’s blood alcohol content (BAC) would have been around 0.13-0.29 at the time of the incident, exceeding the legal limit. 
  3. Witness testimony: Some witnesses at the party claimed they did not see O’Keefe inside the home, suggesting he never made it there. 
  4. Suspicious online searches: Prosecutors allege that Jennifer McCabe, one of the women with Read, searched for “how long does it take for someone to die of hypothermia” around 2:27 a.m. on January 29, several hours before O’Keefe’s body was found.  McCabe denies this, claiming she was searching for a basketball team for her daughter.

The Defense’s Allegations of a Cover-up

Read’s defense team, led by attorney David Yannetti, has presented a vastly different narrative, alleging that there is a meticulously orchestrated cover-up involving members of several law enforcement agencies. 

The defense claims that O’Keefe was beaten by someone else inside the home, possibly bitten by a dog, and then left outside, rather than being struck by Read’s vehicle.  They argue that investigators focused on Read because she was a “convenient outsider” who saved them from having to consider other suspects, including Brian Albert, the homeowner, and Brian Higgins, an ATF agent who was present at the party. 

Yannetti has also criticized the lead investigator, Massachusetts State Police Trooper Michael Proctor, for his close relationships with several witnesses, including the brother of the man who hosted the house party where O’Keefe’s body was found. The defense has accused Proctor of sharing details of the investigation with friends and family and singling out Read as responsible for O’Keefe’s death less than 24 hours after his body was discovered. 

Furthermore, the defense has presented evidence of a “romantic entanglement” between Read and Higgins, the ATF agent, suggesting that this could have played a role in the events of that night.  They have also highlighted the involvement of a controversial blogger known as “Turtleboy,” Aiden Kearney, who now faces charges in related cases. 

The Ongoing Trial and Jury Selection

The Karen Read trial began with jury selection on April 16, 2024, and is expected to last 6-8 weeks.  The process of seating a jury has been a lengthy one, with four jurors added on the first day, seven more on the second day, and two more on the third day, with one juror from a previous day being excused. 

On March 26, 2024, Judge Cannone denied a defense motion to dismiss the case, stating that there was “extensive evidence supporting the indictments.”  During the final pretrial hearing on April 12, 2024, the judge heard 30 different motions, including the defense’s argument that they should be allowed to present a third-party culprit defense, which the prosecution called a “fanciful story.” 

The trial has already seen a significant amount of evidence presented, including a slideshow of photographs from the crime scene and surveillance footage from the bars the couple visited on the night of the incident.  Testimony from various witnesses, including O’Keefe’s brother, bartenders, and friends who were present that night, has also been heard.
